國務院關于加強和規范事中事后監管的指導意見

各省(sheng)、自治區(qu)、直轄(xia)市(shi)人民政(zheng)府,國務院各部委、各直屬(shu)機構:

為(wei)深刻轉變政(zheng)府職能,深化(hua)簡政(zheng)放權、放管(guan)結合、優化(hua)服(fu)務改(gai)革,進(jin)一(yi)步加(jia)強和規范事中(zhong)事后監(jian)(jian)管(guan),以公(gong)正(zheng)監(jian)(jian)管(guan)促進(jin)公(gong)平(ping)競(jing)爭,加(jia)快打造市場(chang)化(hua)法治化(hua)國際化(hua)營(ying)商環境,提出以下意見(jian)。

一、總(zong)體要求

(一)指導(dao)思想(xiang)。以習近平(ping)新時代中(zhong)(zhong)國特色社會主義思想(xiang)為(wei)指導(dao),全面貫徹黨的(de)十九(jiu)大和十九(jiu)屆二中(zhong)(zhong)、三中(zhong)(zhong)全會精神(shen),牢固樹立新發(fa)(fa)(fa)展理念(nian),充分發(fa)(fa)(fa)揮市(shi)(shi)場(chang)(chang)在資(zi)源(yuan)配置中(zhong)(zhong)的(de)決定性作(zuo)用,更好發(fa)(fa)(fa)揮政府作(zuo)用,持續(xu)深化(hua)“放(fang)管(guan)(guan)(guan)(guan)服”改革,堅持放(fang)管(guan)(guan)(guan)(guan)結合、并重,把(ba)更多行政資(zi)源(yuan)從事(shi)(shi)前審(shen)批轉(zhuan)到加強(qiang)事(shi)(shi)中(zhong)(zhong)事(shi)(shi)后(hou)監(jian)(jian)(jian)管(guan)(guan)(guan)(guan)上來,落實(shi)(shi)監(jian)(jian)(jian)管(guan)(guan)(guan)(guan)責任,健全監(jian)(jian)(jian)管(guan)(guan)(guan)(guan)規則,創(chuang)新監(jian)(jian)(jian)管(guan)(guan)(guan)(guan)方式,加快構建權責明(ming)確、公平(ping)公正、公開(kai)透明(ming)、簡約高(gao)效的(de)事(shi)(shi)中(zhong)(zhong)事(shi)(shi)后(hou)監(jian)(jian)(jian)管(guan)(guan)(guan)(guan)體(ti)系,形(xing)成市(shi)(shi)場(chang)(chang)自律、政府監(jian)(jian)(jian)管(guan)(guan)(guan)(guan)、社會監(jian)(jian)(jian)督互為(wei)支(zhi)撐的(de)協同(tong)監(jian)(jian)(jian)管(guan)(guan)(guan)(guan)格局,切實(shi)(shi)管(guan)(guan)(guan)(guan)出(chu)公平(ping)、管(guan)(guan)(guan)(guan)出(chu)效率、管(guan)(guan)(guan)(guan)出(chu)活(huo)力,促進提高(gao)市(shi)(shi)場(chang)(chang)主體(ti)競爭(zheng)力和市(shi)(shi)場(chang)(chang)效率,推動經濟社會持續(xu)健康發(fa)(fa)(fa)展。

(二)基本原則(ze)。

依法監管(guan)(guan)。堅持權(quan)責法定(ding)、依法行政,法定(ding)職責必須為(wei),法無授權(quan)不可為(wei),嚴(yan)格按(an)照(zhao)法律法規(gui)規(gui)定(ding)履行監管(guan)(guan)責任,規(gui)范監管(guan)(guan)行為(wei),推進事(shi)中事(shi)后監管(guan)(guan)法治(zhi)化(hua)、制度化(hua)、規(gui)范化(hua)。

公(gong)平(ping)公(gong)正(zheng)。對各(ge)類市(shi)場主體(ti)一視同仁,堅(jian)決破(po)除妨礙公(gong)平(ping)競爭的體(ti)制機(ji)制障礙,依法保(bao)護各(ge)類市(shi)場主體(ti)合法權益,確保(bao)權利公(gong)平(ping)、機(ji)會公(gong)平(ping)、規則公(gong)平(ping)。

公(gong)開(kai)(kai)(kai)透明。堅(jian)持(chi)以公(gong)開(kai)(kai)(kai)為常態、不公(gong)開(kai)(kai)(kai)為例外(wai),全(quan)面推進政府監管(guan)(guan)規則、標準、過程、結果等(deng)依(yi)法公(gong)開(kai)(kai)(kai),讓監管(guan)(guan)執(zhi)法在陽(yang)光下運(yun)行(xing),給市場主體以穩定預期。

分級分類。根據不(bu)同(tong)領域特(te)點和(he)(he)風險程(cheng)度,區分一般(ban)領域和(he)(he)可能造成嚴重(zhong)不(bu)良后果、涉及(ji)安全的(de)重(zhong)要領域,分別確定監管內(nei)容、方式和(he)(he)頻次,提升事中事后監管精準化(hua)水平(ping)。對新興產業(ye)實(shi)施包容審慎監管,促進(jin)新動(dong)能發(fa)展(zhan)壯大。

科學高效。充分發揮現代科技手段在事(shi)中事(shi)后監管中的作用,依托互聯網、大數據、物聯網、云(yun)計(ji)算、人工智能(neng)、區塊鏈(lian)等新技術(shu)推(tui)動監管創(chuang)新,努力(li)做到監管效能(neng)最大化、監管成本最優化、對市(shi)場(chang)主體(ti)干擾最小化。

寓(yu)管于(yu)服。推進政府監管與服務相互(hu)結合、相互(hu)促(cu)進,堅持行“簡(jian)(jian)約”之道,做到程(cheng)序、要件(jian)等刪繁就簡(jian)(jian)、利企(qi)便民(min),營(ying)造良好(hao)發展環境,增強人(ren)民(min)群眾幸福(fu)感(gan)、獲得(de)感(gan)和安全感(gan)。

二、夯實監管責(ze)任(ren)

(三)明確(que)監(jian)(jian)(jian)(jian)(jian)(jian)管(guan)(guan)對象和范圍。要(yao)(yao)(yao)嚴(yan)格(ge)按照法律法規(gui)和“三定(ding)”規(gui)定(ding)明確(que)的(de)(de)監(jian)(jian)(jian)(jian)(jian)(jian)管(guan)(guan)職(zhi)責(ze)(ze)和監(jian)(jian)(jian)(jian)(jian)(jian)管(guan)(guan)事(shi)項,依(yi)(yi)法對市(shi)場(chang)主體(ti)進(jin)行(xing)(xing)監(jian)(jian)(jian)(jian)(jian)(jian)管(guan)(guan),做(zuo)到監(jian)(jian)(jian)(jian)(jian)(jian)管(guan)(guan)全覆蓋,杜絕(jue)監(jian)(jian)(jian)(jian)(jian)(jian)管(guan)(guan)盲(mang)區和真空。除法律法規(gui)另有規(gui)定(ding)外,各(ge)部(bu)(bu)門(men)對負責(ze)(ze)審(shen)批或指(zhi)導實施的(de)(de)行(xing)(xing)政(zheng)許可事(shi)項,負責(ze)(ze)事(shi)中事(shi)后監(jian)(jian)(jian)(jian)(jian)(jian)管(guan)(guan);實行(xing)(xing)相(xiang)對集中行(xing)(xing)政(zheng)許可權(quan)改革(ge)的(de)(de),要(yao)(yao)(yao)加(jia)強審(shen)管(guan)(guan)銜接,把(ba)監(jian)(jian)(jian)(jian)(jian)(jian)管(guan)(guan)責(ze)(ze)任(ren)落(luo)到實處(chu),確(que)保事(shi)有人(ren)管(guan)(guan)、責(ze)(ze)有人(ren)負;對已(yi)經(jing)取消審(shen)批但仍需(xu)政(zheng)府監(jian)(jian)(jian)(jian)(jian)(jian)管(guan)(guan)的(de)(de)事(shi)項,主管(guan)(guan)部(bu)(bu)門(men)負責(ze)(ze)事(shi)中事(shi)后監(jian)(jian)(jian)(jian)(jian)(jian)管(guan)(guan);對下(xia)放審(shen)批權(quan)的(de)(de)事(shi)項,要(yao)(yao)(yao)同時(shi)調整監(jian)(jian)(jian)(jian)(jian)(jian)管(guan)(guan)層級,確(que)保審(shen)批監(jian)(jian)(jian)(jian)(jian)(jian)管(guan)(guan)權(quan)責(ze)(ze)統一;對審(shen)批改為(wei)備案(an)的(de)(de)事(shi)項,主管(guan)(guan)部(bu)(bu)門(men)要(yao)(yao)(yao)加(jia)強核查(cha),對未經(jing)備案(an)從事(shi)相(xiang)關經(jing)營活動的(de)(de)市(shi)場(chang)主體(ti)依(yi)(yi)法予以查(cha)處(chu);對沒有專門(men)執(zhi)(zhi)(zhi)法力量的(de)(de)行(xing)(xing)業和領域(yu),審(shen)批或主管(guan)(guan)部(bu)(bu)門(men)可通過(guo)委托執(zhi)(zhi)(zhi)法、聯(lian)合執(zhi)(zhi)(zhi)法等方式(shi),會同相(xiang)關綜合執(zhi)(zhi)(zhi)法部(bu)(bu)門(men)查(cha)處(chu)違法違規(gui)行(xing)(xing)為(wei),相(xiang)關綜合執(zhi)(zhi)(zhi)法部(bu)(bu)門(men)要(yao)(yao)(yao)積極予以支持。

(四)厘(li)清監(jian)管(guan)(guan)(guan)事權。各部(bu)(bu)(bu)門(men)(men)要(yao)充(chong)分發揮(hui)在規則和(he)(he)標準制(zhi)定、風險研判、統籌(chou)協(xie)調等方面的作用,指導(dao)本系(xi)(xi)統開展(zhan)事中事后監(jian)管(guan)(guan)(guan)。對涉(she)及面廣(guang)、較為重大(da)復(fu)雜的監(jian)管(guan)(guan)(guan)領域和(he)(he)監(jian)管(guan)(guan)(guan)事項,主(zhu)責部(bu)(bu)(bu)門(men)(men)要(yao)發揮(hui)牽頭(tou)作用,相關部(bu)(bu)(bu)門(men)(men)要(yao)協(xie)同配(pei)合,建立健(jian)全工作協(xie)調機制(zhi)。省級(ji)人民(min)政(zheng)府(fu)(fu)要(yao)統籌(chou)制(zhi)定本行政(zheng)區域內監(jian)管(guan)(guan)(guan)計劃任(ren)(ren)務,指導(dao)和(he)(he)督促省級(ji)部(bu)(bu)(bu)門(men)(men)、市縣(xian)級(ji)人民(min)政(zheng)府(fu)(fu)加(jia)(jia)強和(he)(he)規范監(jian)管(guan)(guan)(guan)執法;垂(chui)直管(guan)(guan)(guan)理部(bu)(bu)(bu)門(men)(men)要(yao)統籌(chou)制(zhi)定本系(xi)(xi)統監(jian)管(guan)(guan)(guan)計劃任(ren)(ren)務,并加(jia)(jia)強與屬(shu)地政(zheng)府(fu)(fu)的協(xie)同配(pei)合。市縣(xian)級(ji)人民(min)政(zheng)府(fu)(fu)要(yao)把(ba)主(zhu)要(yao)精力放在加(jia)(jia)強公正監(jian)管(guan)(guan)(guan)上(shang),維護良好的市場(chang)秩序。

三、健(jian)全監管規則和標準

(五)健全制(zhi)度化監(jian)(jian)管(guan)(guan)(guan)(guan)(guan)規(gui)(gui)(gui)則(ze)。各(ge)部門(men)(men)要圍繞服(fu)務企(qi)業發展,分領域(yu)制(zhi)訂全國(guo)統(tong)一、簡(jian)明(ming)易行(xing)的(de)監(jian)(jian)管(guan)(guan)(guan)(guan)(guan)規(gui)(gui)(gui)則(ze)和標(biao)準(zhun),并(bing)向(xiang)社會(hui)公開,以科學合理(li)(li)的(de)規(gui)(gui)(gui)則(ze)標(biao)準(zhun)提(ti)升監(jian)(jian)管(guan)(guan)(guan)(guan)(guan)有效(xiao)性(xing),降(jiang)低遵從和執法成本。對邊界模糊(hu)、執行(xing)彈性(xing)大的(de)監(jian)(jian)管(guan)(guan)(guan)(guan)(guan)規(gui)(gui)(gui)則(ze)和標(biao)準(zhun),要抓緊清理(li)(li)規(gui)(gui)(gui)范(fan)和修(xiu)訂完善。要結(jie)合權責清單(dan)編制(zhi),在國(guo)家“互聯(lian)網+監(jian)(jian)管(guan)(guan)(guan)(guan)(guan)”系統(tong)監(jian)(jian)管(guan)(guan)(guan)(guan)(guan)事(shi)項目錄清單(dan)基礎上,全面梳理(li)(li)各(ge)級政府和部門(men)(men)職責范(fan)圍內(nei)的(de)監(jian)(jian)管(guan)(guan)(guan)(guan)(guan)事(shi)項,明(ming)確監(jian)(jian)管(guan)(guan)(guan)(guan)(guan)主體、監(jian)(jian)管(guan)(guan)(guan)(guan)(guan)對象、監(jian)(jian)管(guan)(guan)(guan)(guan)(guan)措(cuo)施、設定(ding)(ding)依據、處理(li)(li)方式(shi)等(deng)內(nei)容,納(na)入國(guo)家“互聯(lian)網+監(jian)(jian)管(guan)(guan)(guan)(guan)(guan)”系統(tong)統(tong)一管(guan)(guan)(guan)(guan)(guan)理(li)(li)并(bing)動態更新(xin),提(ti)升監(jian)(jian)管(guan)(guan)(guan)(guan)(guan)規(gui)(gui)(gui)范(fan)化、標(biao)準(zhun)化水平(ping)。強化競(jing)爭政策的(de)基礎性(xing)地位,落實并(bing)完善公平(ping)競(jing)爭審查制(zhi)度,加快(kuai)清理(li)(li)妨礙全國(guo)統(tong)一市場和公平(ping)競(jing)爭的(de)各(ge)種規(gui)(gui)(gui)定(ding)(ding)和做(zuo)法。

(六)加(jia)強標準(zhun)(zhun)(zhun)(zhun)(zhun)體(ti)系建設。加(jia)快(kuai)建立完善各領域(yu)國家標準(zhun)(zhun)(zhun)(zhun)(zhun)和行業標準(zhun)(zhun)(zhun)(zhun)(zhun),明確市(shi)場主(zhu)體(ti)應當執行的管理標準(zhun)(zhun)(zhun)(zhun)(zhun)、技術標準(zhun)(zhun)(zhun)(zhun)(zhun)、安全標準(zhun)(zhun)(zhun)(zhun)(zhun)、產(chan)品(pin)標準(zhun)(zhun)(zhun)(zhun)(zhun),嚴格依照標準(zhun)(zhun)(zhun)(zhun)(zhun)開(kai)展(zhan)監管。精(jing)簡整合強制(zhi)(zhi)性(xing)標準(zhun)(zhun)(zhun)(zhun)(zhun),重點加(jia)強安全、衛生(sheng)、節能、環(huan)保等(deng)領域(yu)的標準(zhun)(zhun)(zhun)(zhun)(zhun)建設,優化強制(zhi)(zhi)性(xing)標準(zhun)(zhun)(zhun)(zhun)(zhun)底線。鼓勵(li)企業、社會團體(ti)制(zhi)(zhi)定高于強制(zhi)(zhi)性(xing)標準(zhun)(zhun)(zhun)(zhun)(zhun)的標準(zhun)(zhun)(zhun)(zhun)(zhun),開(kai)展(zhan)標準(zhun)(zhun)(zhun)(zhun)(zhun)自我聲明公開(kai)并承諾(nuo)執行落實,推(tui)動有關產(chan)品(pin)、技術、質量、服務等(deng)標準(zhun)(zhun)(zhun)(zhun)(zhun)與國際接(jie)軌互(hu)認。適(shi)應新經濟新技術發展(zhan)趨勢,及時修訂調(diao)整已有標準(zhun)(zhun)(zhun)(zhun)(zhun),加(jia)快(kuai)新產(chan)業新業態標準(zhun)(zhun)(zhun)(zhun)(zhun)的研究(jiu)制(zhi)(zhi)定。加(jia)強質量認證體(ti)系建設,對涉及安全、健康(kang)、環(huan)保等(deng)方面的產(chan)品(pin)依法實施強制(zhi)(zhi)性(xing)認證。

四、創新和完善監管方式

(七)深入推(tui)進“互(hu)聯(lian)網+監(jian)管(guan)”。依托(tuo)國(guo)(guo)(guo)家(jia)“互(hu)聯(lian)網+監(jian)管(guan)”系(xi)統,聯(lian)通匯聚全(quan)國(guo)(guo)(guo)信(xin)(xin)(xin)(xin)用(yong)信(xin)(xin)(xin)(xin)息(xi)共(gong)(gong)享平(ping)臺(tai)、國(guo)(guo)(guo)家(jia)企業信(xin)(xin)(xin)(xin)用(yong)信(xin)(xin)(xin)(xin)息(xi)公示系(xi)統等(deng)重要監(jian)管(guan)平(ping)臺(tai)數(shu)(shu)(shu)據,以(yi)及各級政府部門、社會投(tou)訴舉報、第三方平(ping)臺(tai)等(deng)數(shu)(shu)(shu)據,加(jia)強(qiang)監(jian)管(guan)信(xin)(xin)(xin)(xin)息(xi)歸集(ji)共(gong)(gong)享,將政府履(lv)職過程(cheng)中形(xing)成的行(xing)政檢查、行(xing)政處罰、行(xing)政強(qiang)制等(deng)信(xin)(xin)(xin)(xin)息(xi)以(yi)及司法判決、違(wei)法失信(xin)(xin)(xin)(xin)、抽查抽檢等(deng)信(xin)(xin)(xin)(xin)息(xi)進行(xing)關聯(lian)整合,并歸集(ji)到相關市(shi)場主體名下。充分運用(yong)大數(shu)(shu)(shu)據等(deng)技術,加(jia)強(qiang)對風險的跟蹤預警。探索推(tui)行(xing)以(yi)遠程(cheng)監(jian)管(guan)、移動監(jian)管(guan)、預警防控(kong)為特(te)征的非(fei)現場監(jian)管(guan),提升監(jian)管(guan)精準(zhun)化(hua)、智能化(hua)水(shui)平(ping)。

(八)提(ti)升(sheng)信(xin)(xin)(xin)(xin)用(yong)(yong)監(jian)管效能。以統一社(she)會(hui)信(xin)(xin)(xin)(xin)用(yong)(yong)代碼為(wei)標識,依(yi)(yi)(yi)法(fa)依(yi)(yi)(yi)規建(jian)(jian)立(li)權威、統一、可查(cha)詢的(de)市場主體(ti)信(xin)(xin)(xin)(xin)用(yong)(yong)記錄。大力(li)推(tui)行信(xin)(xin)(xin)(xin)用(yong)(yong)承(cheng)諾制度,將信(xin)(xin)(xin)(xin)用(yong)(yong)承(cheng)諾履行情(qing)況納入信(xin)(xin)(xin)(xin)用(yong)(yong)記錄。推(tui)進(jin)信(xin)(xin)(xin)(xin)用(yong)(yong)分級分類(lei)監(jian)管,依(yi)(yi)(yi)據企業(ye)信(xin)(xin)(xin)(xin)用(yong)(yong)情(qing)況,在監(jian)管方(fang)式、抽(chou)查(cha)比例和頻次(ci)等(deng)(deng)方(fang)面采取差異化措施。規范認定并設立(li)市場主體(ti)信(xin)(xin)(xin)(xin)用(yong)(yong)“黑名單(dan)”,建(jian)(jian)立(li)企業(ye)信(xin)(xin)(xin)(xin)用(yong)(yong)與自然(ran)人(ren)信(xin)(xin)(xin)(xin)用(yong)(yong)掛鉤(gou)機制,強化跨行業(ye)、跨領(ling)域、跨部門失信(xin)(xin)(xin)(xin)聯合懲戒,對(dui)失信(xin)(xin)(xin)(xin)主體(ti)在行業(ye)準入、項目審批、獲得信(xin)(xin)(xin)(xin)貸、發票領(ling)用(yong)(yong)、出口退(tui)稅、出入境(jing)、高(gao)消費等(deng)(deng)方(fang)面依(yi)(yi)(yi)法(fa)予(yu)以限制。建(jian)(jian)立(li)健全信(xin)(xin)(xin)(xin)用(yong)(yong)修(xiu)復、異議申(shen)訴等(deng)(deng)機制。在保護涉及公共安全、國家秘密、商(shang)業(ye)秘密和個人(ren)隱私等(deng)(deng)信(xin)(xin)(xin)(xin)息的(de)前(qian)提(ti)下,依(yi)(yi)(yi)法(fa)公開在行政管理(li)中掌握的(de)信(xin)(xin)(xin)(xin)用(yong)(yong)信(xin)(xin)(xin)(xin)息,為(wei)社(she)會(hui)公眾提(ti)供(gong)便(bian)捷高(gao)效的(de)信(xin)(xin)(xin)(xin)用(yong)(yong)查(cha)詢服務(wu)。

(九)全(quan)面(mian)(mian)實施(shi)“雙(shuang)隨(sui)(sui)機(ji)(ji)(ji)、一(yi)公開(kai)”監(jian)(jian)(jian)管。在市場監(jian)(jian)(jian)管領域(yu)全(quan)面(mian)(mian)實行(xing)(xing)隨(sui)(sui)機(ji)(ji)(ji)抽(chou)(chou)取檢(jian)查(cha)(cha)(cha)(cha)(cha)對(dui)象、隨(sui)(sui)機(ji)(ji)(ji)選派執法檢(jian)查(cha)(cha)(cha)(cha)(cha)人(ren)員、抽(chou)(chou)查(cha)(cha)(cha)(cha)(cha)情況及查(cha)(cha)(cha)(cha)(cha)處結果及時(shi)向社會(hui)公開(kai),除(chu)特殊(shu)行(xing)(xing)業、重(zhong)點(dian)領域(yu)外,原則(ze)上(shang)所有(you)日常涉企行(xing)(xing)政檢(jian)查(cha)(cha)(cha)(cha)(cha)都應通過“雙(shuang)隨(sui)(sui)機(ji)(ji)(ji)、一(yi)公開(kai)”的方式進行(xing)(xing)。不斷(duan)完(wan)善“雙(shuang)隨(sui)(sui)機(ji)(ji)(ji)、一(yi)公開(kai)”監(jian)(jian)(jian)管相(xiang)關配套制(zhi)度(du)(du)(du)和工作機(ji)(ji)(ji)制(zhi),健全(quan)跨部門(men)(men)隨(sui)(sui)機(ji)(ji)(ji)抽(chou)(chou)查(cha)(cha)(cha)(cha)(cha)事(shi)項清單,將更多事(shi)項納入跨部門(men)(men)聯合(he)抽(chou)(chou)查(cha)(cha)(cha)(cha)(cha)范圍。將隨(sui)(sui)機(ji)(ji)(ji)抽(chou)(chou)查(cha)(cha)(cha)(cha)(cha)的比例頻(pin)次、被抽(chou)(chou)查(cha)(cha)(cha)(cha)(cha)概率與抽(chou)(chou)查(cha)(cha)(cha)(cha)(cha)對(dui)象的信(xin)(xin)用等級、風(feng)險程度(du)(du)(du)掛鉤,對(dui)有(you)不良信(xin)(xin)用記錄、風(feng)險高(gao)的要加大(da)抽(chou)(chou)查(cha)(cha)(cha)(cha)(cha)力度(du)(du)(du),對(dui)信(xin)(xin)用較(jiao)好(hao)、風(feng)險較(jiao)低的可適當(dang)減少抽(chou)(chou)查(cha)(cha)(cha)(cha)(cha)。抽(chou)(chou)查(cha)(cha)(cha)(cha)(cha)結果要分別通過國家企業信(xin)(xin)用信(xin)(xin)息(xi)公示系統(tong)、“信(xin)(xin)用中國”網站、國家“互聯網+監(jian)(jian)(jian)管”系統(tong)等全(quan)面(mian)(mian)進行(xing)(xing)公示。

(十)對重(zhong)(zhong)(zhong)點(dian)(dian)(dian)(dian)領域實(shi)行(xing)(xing)重(zhong)(zhong)(zhong)點(dian)(dian)(dian)(dian)監(jian)(jian)管(guan)(guan)。對直接(jie)涉(she)及(ji)公共安(an)(an)全(quan)和(he)人民群眾生(sheng)命健康(kang)等特(te)殊重(zhong)(zhong)(zhong)點(dian)(dian)(dian)(dian)領域,依(yi)法依(yi)規(gui)實(shi)行(xing)(xing)全(quan)覆(fu)蓋的(de)重(zhong)(zhong)(zhong)點(dian)(dian)(dian)(dian)監(jian)(jian)管(guan)(guan),強化全(quan)過(guo)程質量管(guan)(guan)理,加(jia)強安(an)(an)全(quan)生(sheng)產(chan)(chan)監(jian)(jian)管(guan)(guan)執法,嚴格落實(shi)生(sheng)產(chan)(chan)、經(jing)營、使用、檢測、監(jian)(jian)管(guan)(guan)等各環(huan)節質量和(he)安(an)(an)全(quan)責任,守住質量和(he)安(an)(an)全(quan)底線。對食品(pin)、藥品(pin)、醫療器械、特(te)種設備(bei)等重(zhong)(zhong)(zhong)點(dian)(dian)(dian)(dian)產(chan)(chan)品(pin),建(jian)立(li)健全(quan)以產(chan)(chan)品(pin)編(bian)碼管(guan)(guan)理為手段(duan)的(de)追溯(su)體系,形成來源可(ke)查、去向可(ke)追、責任可(ke)究的(de)信息鏈條。地方各級(ji)政府可(ke)根據區域和(he)行(xing)(xing)業風險特(te)點(dian)(dian)(dian)(dian),探索建(jian)立(li)重(zhong)(zhong)(zhong)點(dian)(dian)(dian)(dian)監(jian)(jian)管(guan)(guan)清單(dan)制(zhi)度,嚴格控制(zhi)重(zhong)(zhong)(zhong)點(dian)(dian)(dian)(dian)監(jian)(jian)管(guan)(guan)事項數量,規(gui)范重(zhong)(zhong)(zhong)點(dian)(dian)(dian)(dian)監(jian)(jian)管(guan)(guan)程序(xu),并篩選確定重(zhong)(zhong)(zhong)點(dian)(dian)(dian)(dian)監(jian)(jian)管(guan)(guan)的(de)生(sheng)產(chan)(chan)經(jing)營單(dan)位,實(shi)行(xing)(xing)跟蹤監(jian)(jian)管(guan)(guan)、直接(jie)指導。

(十(shi)一(yi))落實和完(wan)善包容審慎監管。對(dui)新(xin)(xin)(xin)技術、新(xin)(xin)(xin)產業、新(xin)(xin)(xin)業態(tai)、新(xin)(xin)(xin)模式,要按照鼓勵創(chuang)新(xin)(xin)(xin)原則,留足(zu)發(fa)展(zhan)空(kong)間(jian),同時堅(jian)守質量和安全(quan)底(di)線,嚴(yan)禁(jin)簡單(dan)封殺或放(fang)任不管。加強(qiang)對(dui)新(xin)(xin)(xin)生事(shi)物發(fa)展(zhan)規(gui)(gui)律研究,分類量身定(ding)制監管規(gui)(gui)則和標(biao)準(zhun)。對(dui)看得(de)準(zhun)、有發(fa)展(zhan)前景的(de),要引導(dao)其健康規(gui)(gui)范發(fa)展(zhan);對(dui)一(yi)時看不準(zhun)的(de),設置(zhi)(zhi)一(yi)定(ding)的(de)“觀察期(qi)”,對(dui)出現的(de)問題及時引導(dao)或處(chu)置(zhi)(zhi);對(dui)潛在風(feng)險(xian)大、可能造成嚴(yan)重不良后果(guo)的(de),嚴(yan)格監管;對(dui)非法經營的(de),堅(jian)決依法予以(yi)查處(chu)。推進(jin)線上線下(xia)一(yi)體(ti)化(hua)監管,統一(yi)執法標(biao)準(zhun)和尺度。

(十二(er))依(yi)法(fa)開展案件查辦。對(dui)監管中發現的違法(fa)違規問題,綜(zong)合運用行政(zheng)強(qiang)制、行政(zheng)處(chu)罰、聯(lian)合懲(cheng)(cheng)戒、移送(song)司(si)法(fa)機關處(chu)理(li)等手(shou)段,依(yi)法(fa)進行懲(cheng)(cheng)處(chu)。對(dui)情節輕(qing)微、負面影響較小的苗頭性問題,在(zai)堅持依(yi)法(fa)行政(zheng)的同時,主(zhu)要(yao)采(cai)取約(yue)談、警告、責令改正等措施,及時予(yu)以糾正。對(dui)情節和后果嚴重的,要(yao)依(yi)法(fa)責令下架召回(hui)、停工停產或撤銷吊銷相關證(zheng)照,涉(she)及犯罪的要(yao)及時移送(song)司(si)法(fa)機關處(chu)理(li)。建立完善違法(fa)嚴懲(cheng)(cheng)制度(du)(du)、懲(cheng)(cheng)罰性賠償和巨額罰款制度(du)(du)、終身禁入機制,讓(rang)嚴重違法(fa)者(zhe)付出(chu)高昂成本。

五、構(gou)建協同(tong)監管格局

(十(shi)三(san))加強(qiang)政(zheng)府協(xie)同(tong)監(jian)(jian)(jian)管。加快轉變(bian)傳統(tong)監(jian)(jian)(jian)管方(fang)式(shi),打(da)破條塊分割,打(da)通準入(ru)、生產、流通、消費等監(jian)(jian)(jian)管環節(jie),建(jian)立(li)健全跨(kua)部門、跨(kua)區域(yu)執(zhi)法(fa)(fa)聯動響應和(he)協(xie)作機制,實現違法(fa)(fa)線索互(hu)(hu)聯、監(jian)(jian)(jian)管標準互(hu)(hu)通、處(chu)理結果互(hu)(hu)認。深化市場監(jian)(jian)(jian)管、生態環境(jing)保護、交通運輸(shu)、農業、文化市場綜合(he)行政(zheng)執(zhi)法(fa)(fa)改革(ge),在(zai)其他具備(bei)條件的領域(yu)也要(yao)積極推進綜合(he)行政(zheng)執(zhi)法(fa)(fa)改革(ge),統(tong)籌配置行政(zheng)處(chu)罰職能和(he)執(zhi)法(fa)(fa)資源(yuan),相對集中行政(zheng)處(chu)罰權,整(zheng)合(he)精簡執(zhi)法(fa)(fa)隊(dui)伍,推進行政(zheng)執(zhi)法(fa)(fa)權限和(he)力量向基層(ceng)鄉鎮(zhen)街道延伸下沉(chen),逐步實現基層(ceng)一(yi)支(zhi)隊(dui)伍管執(zhi)法(fa)(fa),解(jie)決多頭多層(ceng)重復執(zhi)法(fa)(fa)問題(ti)。

(十四(si))強(qiang)(qiang)(qiang)化市場(chang)主體責任。建立完善(shan)(shan)市場(chang)主體首(shou)負責任制,促(cu)(cu)使市場(chang)主體在安全生產、質量(liang)管理、營銷宣傳、售(shou)后服務、誠信納稅等方面加(jia)強(qiang)(qiang)(qiang)自(zi)(zi)我監(jian)督、履行法定(ding)義務。督促(cu)(cu)涉及公眾(zhong)健康和(he)安全等的企業(ye)(ye)建立完善(shan)(shan)內(nei)控和(he)風險防范(fan)(fan)機(ji)制,落實專人負責,強(qiang)(qiang)(qiang)化員工安全教(jiao)育,加(jia)強(qiang)(qiang)(qiang)內(nei)部安全檢查。規范(fan)(fan)企業(ye)(ye)信息(xi)披露(lu),進一步加(jia)強(qiang)(qiang)(qiang)年(nian)報公示,推行“自(zi)(zi)我聲(sheng)明+信用管理”模(mo)式,推動企業(ye)(ye)開展標準(zhun)自(zi)(zi)我聲(sheng)明和(he)服務質量(liang)公開承(cheng)諾。加(jia)快建立產品(pin)質量(liang)安全事故(gu)強(qiang)(qiang)(qiang)制報告(gao)制度(du),切實保障(zhang)公眾(zhong)知情(qing)權。

(十五(wu))提升行(xing)(xing)(xing)(xing)(xing)業(ye)自(zi)(zi)治(zhi)水平。推動行(xing)(xing)(xing)(xing)(xing)業(ye)協會(hui)(hui)商會(hui)(hui)建立(li)健全行(xing)(xing)(xing)(xing)(xing)業(ye)經營自(zi)(zi)律(lv)規(gui)范(fan)、自(zi)(zi)律(lv)公約和(he)職業(ye)道德準(zhun)(zhun)則,規(gui)范(fan)會(hui)(hui)員行(xing)(xing)(xing)(xing)(xing)為。鼓(gu)勵行(xing)(xing)(xing)(xing)(xing)業(ye)協會(hui)(hui)商會(hui)(hui)參與制(zhi)定(ding)國家標準(zhun)(zhun)、行(xing)(xing)(xing)(xing)(xing)業(ye)規(gui)劃和(he)政策法規(gui),制(zhi)定(ding)發布(bu)行(xing)(xing)(xing)(xing)(xing)業(ye)產品和(he)服(fu)務標準(zhun)(zhun)。發揮行(xing)(xing)(xing)(xing)(xing)業(ye)協會(hui)(hui)商會(hui)(hui)在權益(yi)保護、糾紛處理、行(xing)(xing)(xing)(xing)(xing)業(ye)信(xin)用建設和(he)信(xin)用監管(guan)等方面的作用,支持行(xing)(xing)(xing)(xing)(xing)業(ye)協會(hui)(hui)商會(hui)(hui)開展(zhan)或參與公益(yi)訴訟、專業(ye)調解(jie)工(gong)作。規(gui)范(fan)行(xing)(xing)(xing)(xing)(xing)業(ye)協會(hui)(hui)商會(hui)(hui)收費、評獎、認證等行(xing)(xing)(xing)(xing)(xing)為。

(十(shi)六)發(fa)揮社會(hui)監(jian)督作用(yong)。建立“吹(chui)哨人”、內(nei)部舉(ju)報(bao)人等制度,對舉(ju)報(bao)嚴重違(wei)法(fa)(fa)違(wei)規行(xing)為和(he)重大風險(xian)隱患的(de)有功(gong)人員予以重獎和(he)嚴格保護。暢通群眾(zhong)監(jian)督渠道,整合優化政府投訴舉(ju)報(bao)平臺功(gong)能(neng),力爭做到“一號響(xiang)應”。依法(fa)(fa)規范牟利性“打假”和(he)索賠行(xing)為。培育信(xin)用(yong)服務(wu)機構(gou),鼓勵開展信(xin)用(yong)評(ping)級和(he)第(di)三方(fang)評(ping)估(gu)。發(fa)揮會(hui)計、法(fa)(fa)律(lv)、資(zi)產評(ping)估(gu)、認證(zheng)檢(jian)驗檢(jian)測、公證(zheng)、仲裁、稅務(wu)等專業(ye)機構(gou)的(de)監(jian)督作用(yong),在監(jian)管執(zhi)法(fa)(fa)中更(geng)多參考專業(ye)意見。強化輿論監(jian)督,持續曝光典型案(an)件,震懾違(wei)法(fa)(fa)行(xing)為。

六、提升監管規范性和透明(ming)度(du)

(十七)規(gui)范涉(she)企(qi)行(xing)(xing)政(zheng)檢(jian)(jian)(jian)查(cha)和處(chu)罰。對(dui)涉(she)企(qi)現(xian)場檢(jian)(jian)(jian)查(cha)事(shi)(shi)(shi)項(xiang)(xiang)(xiang)進行(xing)(xing)全面梳理(li)(li)論證,通過取消、整(zheng)合(he)、轉為非現(xian)場檢(jian)(jian)(jian)查(cha)等方式(shi),壓減重(zhong)復(fu)或不必要的檢(jian)(jian)(jian)查(cha)事(shi)(shi)(shi)項(xiang)(xiang)(xiang),著力解決涉(she)企(qi)現(xian)場檢(jian)(jian)(jian)查(cha)事(shi)(shi)(shi)項(xiang)(xiang)(xiang)多(duo)、頻次高、隨意檢(jian)(jian)(jian)查(cha)等問題。清理(li)(li)規(gui)范行(xing)(xing)政(zheng)處(chu)罰事(shi)(shi)(shi)項(xiang)(xiang)(xiang),對(dui)重(zhong)復(fu)處(chu)罰、標準不一(yi)、上(shang)位法(fa)已作調整(zheng)的事(shi)(shi)(shi)項(xiang)(xiang)(xiang)及時進行(xing)(xing)精簡(jian)和規(gui)范。加強行(xing)(xing)政(zheng)執法(fa)事(shi)(shi)(shi)項(xiang)(xiang)(xiang)目錄管理(li)(li),從(cong)源頭(tou)上(shang)減少不必要的執法(fa)事(shi)(shi)(shi)項(xiang)(xiang)(xiang)。健全行(xing)(xing)政(zheng)執法(fa)自由裁(cai)(cai)(cai)量基準制度,合(he)理(li)(li)確(que)定裁(cai)(cai)(cai)量范圍、種類和幅度,嚴格限定裁(cai)(cai)(cai)量權的行(xing)(xing)使。禁(jin)止將罰沒(mei)收(shou)入(ru)與(yu)行(xing)(xing)政(zheng)執法(fa)機關利益掛鉤。

(十八)全面推(tui)進監管(guan)執(zhi)法(fa)公(gong)(gong)(gong)開。聚焦行(xing)政(zheng)執(zhi)法(fa)的源頭、過(guo)(guo)程、結(jie)果等(deng)(deng)關鍵環(huan)節(jie),嚴(yan)格落實行(xing)政(zheng)執(zhi)法(fa)公(gong)(gong)(gong)示(shi)、執(zhi)法(fa)全過(guo)(guo)程記錄(lu)、重(zhong)(zhong)大(da)(da)執(zhi)法(fa)決定法(fa)制(zhi)審核(he)(he)制(zhi)度。建立統一(yi)的執(zhi)法(fa)信息公(gong)(gong)(gong)示(shi)平臺,按照“誰(shui)執(zhi)法(fa)誰(shui)公(gong)(gong)(gong)示(shi)”原(yuan)則,除涉及(ji)國家秘(mi)密(mi)(mi)、商(shang)業秘(mi)密(mi)(mi)、個人(ren)隱(yin)私(si)等(deng)(deng)依(yi)(yi)法(fa)不予(yu)公(gong)(gong)(gong)開的信息外,行(xing)政(zheng)執(zhi)法(fa)職(zhi)責、依(yi)(yi)據(ju)、程序、結(jie)果等(deng)(deng)都應(ying)對(dui)社(she)會公(gong)(gong)(gong)開。對(dui)行(xing)政(zheng)執(zhi)法(fa)的啟動、調查(cha)取證、審核(he)(he)決定、送達執(zhi)行(xing)等(deng)(deng)全過(guo)(guo)程進行(xing)記錄(lu),做到全程留(liu)痕和可回(hui)溯管(guan)理。重(zhong)(zhong)大(da)(da)行(xing)政(zheng)執(zhi)法(fa)決定必須經(jing)過(guo)(guo)法(fa)制(zhi)審核(he)(he),未(wei)經(jing)法(fa)制(zhi)審核(he)(he)或(huo)審核(he)(he)未(wei)通(tong)過(guo)(guo)的,不得作出決定。

(十九)健全盡(jin)職(zhi)免責(ze)(ze)(ze)、失(shi)職(zhi)問責(ze)(ze)(ze)辦(ban)(ban)法(fa)(fa)(fa)。全面落實(shi)行(xing)(xing)政執法(fa)(fa)(fa)責(ze)(ze)(ze)任制和問責(ze)(ze)(ze)制,促進監(jian)(jian)(jian)管(guan)執法(fa)(fa)(fa)部門和工作人員(yuan)履職(zhi)盡(jin)責(ze)(ze)(ze)、廉潔自律、公平公正執法(fa)(fa)(fa)。對(dui)忠于職(zhi)守、履職(zhi)盡(jin)責(ze)(ze)(ze)的,要(yao)給予(yu)表揚和鼓勵;對(dui)未(wei)履行(xing)(xing)、不當履行(xing)(xing)或違法(fa)(fa)(fa)履行(xing)(xing)監(jian)(jian)(jian)管(guan)職(zhi)責(ze)(ze)(ze)的,嚴(yan)肅追責(ze)(ze)(ze)問責(ze)(ze)(ze);涉(she)嫌犯罪(zui)的,移送有關(guan)(guan)機關(guan)(guan)依(yi)法(fa)(fa)(fa)處理。加快完(wan)善各監(jian)(jian)(jian)管(guan)執法(fa)(fa)(fa)領域(yu)盡(jin)職(zhi)免責(ze)(ze)(ze)辦(ban)(ban)法(fa)(fa)(fa),明確履職(zhi)標準(zhun)和評(ping)判界線,對(dui)嚴(yan)格依(yi)據法(fa)(fa)(fa)律法(fa)(fa)(fa)規履行(xing)(xing)監(jian)(jian)(jian)管(guan)職(zhi)責(ze)(ze)(ze)、監(jian)(jian)(jian)管(guan)對(dui)象出現(xian)問題的,應結(jie)合(he)動機態度、客觀條件(jian)、程序方法(fa)(fa)(fa)、性質程度、后(hou)果影響以(yi)(yi)及挽回損失(shi)等情(qing)況進行(xing)(xing)綜合(he)分析(xi),符合(he)條件(jian)的要(yao)予(yu)以(yi)(yi)免責(ze)(ze)(ze)。

七(qi)、強化組織保障

(二十)認真(zhen)抓好(hao)責(ze)任落(luo)實(shi)。各(ge)地(di)區、各(ge)部門要認真(zhen)貫徹落(luo)實(shi)黨(dang)中(zhong)央、國(guo)(guo)務(wu)院決策部署,按照本意見(jian)提出的(de)各(ge)項(xiang)(xiang)措(cuo)施(shi)和要求,落(luo)實(shi)和強化監(jian)管(guan)責(ze)任,科(ke)學配置(zhi)監(jian)管(guan)資源,鼓勵(li)基層探索創新(xin),細化實(shi)化監(jian)管(guan)措(cuo)施(shi),切實(shi)維護公平競爭秩序。將地(di)方政府公正監(jian)管(guan)水平納入中(zhong)國(guo)(guo)營(ying)商環境評價(jia)指標體系。國(guo)(guo)務(wu)院辦公廳負責(ze)對本意見(jian)落(luo)實(shi)工(gong)作(zuo)的(de)跟蹤(zong)督促(cu),確保各(ge)項(xiang)(xiang)任務(wu)和措(cuo)施(shi)落(luo)實(shi)到位。

(二十一)加(jia)強法(fa)(fa)(fa)(fa)治保障。按照重(zhong)大(da)改(gai)革(ge)于法(fa)(fa)(fa)(fa)有(you)據(ju)的要求,根據(ju)監管工作(zuo)需要和(he)(he)經濟社會發展變化,加(jia)快推進相關(guan)法(fa)(fa)(fa)(fa)律法(fa)(fa)(fa)(fa)規和(he)(he)規章立改(gai)廢釋工作(zuo),為(wei)事(shi)中事(shi)后(hou)監管提供(gong)健全的法(fa)(fa)(fa)(fa)治保障。加(jia)強監管執法(fa)(fa)(fa)(fa)與司法(fa)(fa)(fa)(fa)的銜(xian)接,建立監管部(bu)門、公(gong)安(an)機(ji)(ji)關(guan)、檢察機(ji)(ji)關(guan)間案(an)情通報機(ji)(ji)制,完善案(an)件(jian)移送標準和(he)(he)程(cheng)序。

(二(er)十二(er))加強(qiang)監管(guan)能(neng)力建設(she)(she)。加快建設(she)(she)高(gao)素質、職業化、專(zhuan)業化的監管(guan)執(zhi)法(fa)(fa)隊伍,扎實做好技(ji)(ji)能(neng)提(ti)升工作,大力培養“一專(zhuan)多(duo)能(neng)”的監管(guan)執(zhi)法(fa)(fa)人員。推(tui)進人財物等監管(guan)資源向基(ji)層(ceng)下沉,保障基(ji)層(ceng)經費和裝備投(tou)入。推(tui)進執(zhi)法(fa)(fa)裝備標(biao)準化建設(she)(she),提(ti)高(gao)現(xian)代科(ke)技(ji)(ji)手(shou)段(duan)在執(zhi)法(fa)(fa)辦案中的應用水平。
